1. Agreement to Terms

By accessing or using ORIVEN ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Services

ORIVEN is a brand intelligence platform that enables users to build a BrandCore and generate creative assets including campaigns, visuals, videos, copy, and web content. Access to the Service is provided on a subscription basis.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years of age to use the Service.

4. Subscription Plans and Credits

ORIVEN offers paid subscription plans. Each plan includes a monthly allocation of Creative Credits used to generate assets. Credits reset monthly and do not carry over. Prices are listed in euros (€) and may be subject to applicable taxes. By subscribing, you authorize recurring charges to your payment method.

5. Acceptable Use

You agree not to use the Service to generate content that is illegal, harmful, misleading, defamatory, or infringes on third-party rights. You may not attempt to reverse engineer, copy, or resell any part of the platform. We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Content generated using ORIVEN is owned by you, subject to any rights of third-party data sources or models used in generation. ORIVEN retains full ownership of all platform software, branding, visual design, and interface elements.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that outputs will meet any specific standard.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ORIVEN's total liability for any claim arising from use of the Service shall not exceed the total amount paid by you in the three months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved exclusively in the competent courts of the Netherlands.

ORIVEN ("we", "us", "our") is committed to protecting your personal data. This Privacy Policy explains how we collect, use, and protect your information in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch law.

5. Sharing Your Information

We do not sell your personal data. We share data only with trusted service providers that are necessary to operate ORIVEN. Each provider receives only the data required to deliver their specific functionality:

• Supabase — Platform infrastructure, user authentication, and database storage
• Stripe — Secure payment processing and subscription management
• OpenAI — AI content generation (campaigns, copy, visuals, websites, and other generators)
• Anthropic — AI content generation (brand analysis, BrandCore intelligence, and strategic outputs)
• HeyGen — AI video generation (UGC Creator video production)

No personally identifiable information is included in AI generation prompts sent to OpenAI, Anthropic, or HeyGen. Prompts contain only brand-related content you choose to provide within the platform.

6. Data Retention

We retain your account data for as long as your account is active, plus 30 days after deletion. Billing records are retained for 7 years as required by Dutch tax law.

7. Your Rights Under GDPR

As a data subject, you have the right to: access your personal data, correct inaccurate data, request deletion ("right to be forgotten"), restrict or object to processing, and data portability. To exercise any of these rights, email us at studio.oriven@outlook.com. We will respond within 30 days.

1. Overview

ORIVEN offers subscription-based access to its brand intelligence platform. This policy explains when and how refunds are granted. We want every customer to be satisfied with the Service.

2. Subscription Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have full access to the Service until the billing period ends — no credits are lost upon cancellation.

3. Refund Eligibility

Refunds may be granted in the following circumstances:

• You were charged in error (duplicate charge, incorrect amount)
• The Service was unavailable for more than 48 consecutive hours due to our fault
• You request a refund within 7 days of your first subscription payment and have not used more than 10% of your monthly credits

4. Non-Refundable Items

• Credits already consumed in generating content
• Renewal charges after the initial subscription period
• Partial month refunds (outside the 7-day new subscriber window)
• Upgrades or plan changes mid-cycle

5. How to Request a Refund

Email studio.oriven@outlook.com with your account email, subscription details, and reason for the refund request. We review all requests within 5 business days.

6. Processing Time

Approved refunds are processed within 5–10 business days. Funds are returned to your original payment method via Stripe. Processing times may vary depending on your bank or card issuer.

2. How ORIVEN Uses Cookies

ORIVEN uses cookies to keep you signed in, remember your workspace preferences, and understand how the platform is used so we can improve it. We do not use cookies for advertising.

• Essential cookies — Required for the Service to function. These include authentication tokens and session management cookies. They cannot be disabled without breaking the Service.
• Preference cookies — Remember your settings and interface choices (e.g., theme, sidebar state).
• Analytics cookies — Anonymous, aggregated data used to understand usage patterns and improve the platform. No personally identifiable information is linked.

• Hosted on enterprise-grade cloud infrastructure with high availability
• Data stored via Supabase with row-level security policies enforced at the database level

• DDoS protection and rate limiting on all public endpoints

Data Encryption

• All data in transit is encrypted using TLS 1.2 or higher
• Passwords are hashed using industry-standard algorithms and never stored in plain text
• Payment data is handled exclusively by Stripe (PCI-DSS Level 1 compliant) — ORIVEN never stores card numbers
• Data at rest is encrypted by our infrastructure provider

Access Controls

• User accounts are protected by email/password authentication via Supabase Auth
• Sessions use secure, short-lived JWT tokens with automatic expiry
• Administrative access to infrastructure is restricted to authorized personnel only
• Principle of least privilege applied to all internal system permissions

Responsible Disclosure

If you discover a security vulnerability in ORIVEN, we ask that you report it to us responsibly before any public disclosure. We are committed to working with you to understand and resolve the issue quickly.

We kindly ask that you:

• Do not publicly disclose the vulnerability until we have addressed it
• Do not access or modify data belonging to other users
• Act in good faith and avoid any actions that could harm ORIVEN or its users
